Services and Limitations
The form of reservation on the website and the Mobile Application are developed for TDNB, but belong to the third company. At the time of downloading the application, you agree to all terms and conditions of service of such third party beneficiary, not TDNB. TDNB will not be liable for material or financial damages resulting from application downloads and the use of third-party services.
It is your responsibility to verify that you have downloaded the Application that is appropriate for your device. TDNB will not be responsible if you cannot use the application for any reason whatsoever, such as its non-compatibility with your device, lack of Internet connection or GPS. It is your responsibility to verify that the pickup address displayed at the time of booking, found by GPS of your device, is accurate, correct it manually if it is incorrect.
You agree to use the Website or the Application only for lawful purposes. You agree not to use the Website or the Application to harm, hinder, disturb or harass any third party.
TDNB connects the customer and the driver directly with the mobile application and the booking form on the website for the customer to request a service and the driver provides it to the customer. The customer can request different services: passenger transport, delivery, assistance for starting a vehicle, unlocking of car doors etc. You agree that the services may be provided by the drivers who drive the TDNB cars and by owners of their own cars, named here Members. The owner of a taxi, a limousine, a suitable car, a shuttle, a minibus can be a Member of TDNB. The owner of a passenger car can offer all services except passenger transportation. To be allowed to carry passengers, he must have commercial insurance for his car and driver's licenses of category 4, 2 or 1.
All TDNB drivers are self-employed. Every driver of a passenger car for the purpose of profit is personally responsible for maintaining up to date all the permits and documents required by his municipality. He must sign the declaration on honor that he is in good standing before being accepted by TDNB.
Text Messaging and emails
By creating an Account, you agree that the technology platform may send you informational text (SMS) messages as part of the normal business operation of your use of the Services. You hereby consent that TDNB may send you SMS messages and emails, regarding your reservations and for promotional purposes. Message and data rates may apply.
Security and your Responsibilities
Our mobile app is designed to give you maximum security and comfort. During your order you receive all the information about the status of this one, the car and the assigned driver. The driver's photograph and his name are displayed in the Application after the driver accepts the order. The text message and an email will be sent to you with information about the license plate, the taxi company and the driver, as soon as the car will have the status "waiting for passengers".
Before boarding the car, you must check her license plate number, the driver's name, and compare the driver's picture displayed in the application with the person behind the wheel. If something does not match, check with the driver your coordinates. They must be displayed on his tablet. It may not be the car you ordered. If, however, you leave with another car, your order will never be completed in the system. You should cancel it. TDNB will not be responsible for your errors.
You must be sure to need one of our services before placing the order by pressing the "book" button. Cancel your order immediately if you no longer wish to have any of our services. If you no longer require a service and you forget to cancel your order before the driver arrives at the pickup address, you must pay him the amount of travel expenses required by the driver. Customers who repetitively abuse bookings and then do not show up or announce the change of plans to the driver only at the time of arrival at the pickup address will be prohibited from using the Application.
TDNB does not charge or control rates for services. Taxi fares are managed by municipalities. Each driver is free to negotiate the final price of the service with the customer according to local official rates in force. You pay after the ride. For long destinations you have to pay in advance. You undertake to pay the amount of ride claimed by the driver according to the meter or the amount negotiated in advance.
You choose the method of payment. However, you should pay the driver in cash if in your city there are no cars equipped with debit machines. If you want to use your personal or business credit card to pay the fees, you must add it to your mobile app account. To finalize the transaction in application, your Smartphone must be turned on and connected to the Internet. You are responsible for providing accurate information on your card for the transaction to be accepted. In the event of a failing payment by the credit card registered in the application, you must pay your bill by other payment method.
TDNB offers promotional codes to reward users of the Application. They are posted on the website and on the Facebook page. You can claim them and use them during the promotion period, or share them to your friends and earn double their value. If you choose to use it, the code is consumed automatically after the order, and will be deducted from the final amount to be paid.
TDNB alone shall own all right, title and interest, including all related intellectual property rights, in and to the Website, taxidirect.ca. The name and logos of TDNB and the product names associated with the Website and the Application are trademarks of TDNB or third parties and no rights or licenses are granted for their use. Intellectual property in all its forms such as patent, copyright and neighboring rights, communication rights, software, designs, know-how, websites, trademarks, rights transfer and other closely related forms Or by far its current and future professional and research activities remain the property of Taxi Direct New Brunswick.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TDNB DOES NOT PROVIDE ANY CERTIFICATE, WARRANTY OR INSURANCE CONCERNING THE RELIABILITY, PUNCTUALITY, QUALITY, ADEQUACY OR AVAILABILITY OF THE SERVICES OR ANY PROPERTY OR SERVICE ARISING OUT OF THE SERVICES, OR THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERRORS. TDNB DOES NOT WARRANT THE QUALITY, ADEQUACY, SAFETY OR CAPACITY OF MEMBERS. YOU ACCEPT THAT THE RISKS ARISING OUT OF THE USE OF THE SERVICES AND ANY WARRANTY OR SERVICE IN CONNECTION WITH THE LATTERS, WILL BE YOU IN FULL AND ARE YOU ONLY YOURSELF, TO THE FULLEST EXTENT GIVEN BY APPLICABLE LAW.
Limitation of Liability
TDNB WILL NOT BE RESPONSIBLE FOR THE CONDUCT OF ITS MEMBERS. EACH MEMBER SHALL BE PERSONALLY LIABLE FOR ITS BEHAVIOR ON THE ROADS. IN CASE OF ACCIDENT THE VEHICLE INSURANCE MUST COVER ALL DAMAGES. THE OWNER OF THE CAR IS SOLELY RESPONSIBLE FOR HAVING HIS INSURANCE APPROPRIATE AND UP TO DATE.
TDNB WILL NOT BE LIABLE FOR ANY DAMAGES, OBLIGATIONS OR LOSSES ARISING OUT OF: (a) WHAT YOU HAVE USED IN THE SERVICES OR THAT YOU ARE TRUSTED, OR (b) THE IMPOSSIBILITY FOR YOU TO HAVE ACCESS OR USE THE SERVICES; OR (c) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY MEMBER, EVEN IF TDNB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TDNB WILL NOT BE LIABLE FOR DELAY OR EXEMPTION. TDNB REQUIRES ALL MEMBERS TO DECLARE THAT THEY HAVE PERMITS, LICENSES AND ADEQUATE INSURANCES TO PROVIDE SERVICES. IF YOU FIND AN INFRINGEMENT BY ONE OF THE MEMBERS, INFORM TDNB. IT WILL BE DISCONNECTED FROM THE SYSTEM. TDNB WILL NOT BE RESPONSIBLE FOR THE FACTS AND GESTURES OF ITS MEMBERS OR FOR ANY ILLEGAL USE OF THE SERVICE PROVIDED. IN NO EVENT SHALL TDNB BE LIABLE TO PAY FOR DAMAGES, LOSSES, AND CAUSES OF ACTION.
